Terms & Conditions for the Whalebone Pizza Box Art Contest

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

Rules of the competition:

  1. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept these rules as it relates to the contest.
  2. The Whalebone Pizza Box Art Contest (the “contest”) is open to everyone but is void where prohibited by law. Employees of Whalebone Media, supporting partners and their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each are not eligible to participate in the contest. The contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. For entrants under 18, you’ll need a legal guardian to submit on your behalf. Entrants are welcome to submit more than one design but are not allowed to submit the same design more than once.
  3. It is free to enter.
  4. A copy of extant work will be disqualified. Designs that have been submitted to other competitions will be not accepted.
  5. The Organizer reserves the right to change the Rules of Competition.
  6. The Organizer assumes no obligation, responsibility, or liability for any expenses incurred by the entrants as a result of participating in this competition or for any damage or loss of all entries due to electronic transmission via the online platform.

Announcement of results:

  1. Winners will be notified within 1 to 2 weeks of the contest ending. Non-winning entrants will not be individually notified of the results. Details of the result will be posted on the Organizer website and magazine after.

Collection of entries:

  1. Contest Period: Entries will be accepted online starting on or about June 27, 2023, and ending July 10, 2023.
  2. Announcement of results: All online entries must be received by 11:59 PM EST on July 10, 2023.
  3. How to Enter: The contest must be entered by submitting an entry using the online form provided on this contest site, located at https://whalebone.awardsplatform.com/. The entry must fulfill all contest requirements, as specified, to be eligible to win a prize including utilizing the provided pizza box template available here. (Only the file types PDF, JPEG, or TIFs will be accepted.) Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Whalebone Magazine. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Whalebone Magazine.

Design and intellectual property right registration:

  1. By submitting the designs, images, and prototypes to the Whalebone Pizza Box Art Contest, each Entrant agrees that he/she is authorized to and hereby grants the Whalebone Pizza Box Art Contest and its licensees and assignees, a royalty-free, non-exclusive, worldwide, perpetual license to exercise all rights to copy, edit and/or modify, publicly display, publicly perform, broadcast, publish and use, in whole or in part, any Submission, and any other intellectual property protected or protectable materials submitted by each Entrant, in any manner without further compensation during and after the Competition, except where prohibited by law.
  2. By entering the contest Entrant agrees that design(s) may be used for any marketing and promotion around The Pizza Issue, Pizza Contest, and any future promotions.
  3. Every Entrant should note that the Submission will be publicly disclosed. If deemed necessary or appropriate, the entrant should file a patent application before submission. Nevertheless, every Entrant shall be solely responsible for the pursuit of any form of intellectual property protection for the Submission. The Organizer is not liable for infringement or abuse of any design as a result of entry into the Whalebone Pizza Box Art Contest or as a result of any subsequent promotion and publicity.
  4. The Organisers will not be responsible for proof of originality of all entries, nor be liable for protection of design copyright. Each contestant retains sole copyright and is therefore solely liable for his/her design(s).
  5. No personal details will be published without the contestants’ prior approval sought in writing. Only the Organizer will have access to any personal data provided by the contestants.
  6. In the event of any disputes, the Organizer reserves the right to disqualify any entry and/or retract any award from the entrant. All decisions made by the Organizer are final and binding in all aspects relating to the Competition.
  7. By entering this competition you warrant that:
    (a) All details provided with your entry are true and accurate;
    (b) You are entering the competition as an individual, and not on behalf of any company of organization;
    (c) You have all necessary rights and licenses to grant the rights set out in these Rules & Regulations;
    (d) The design, images, and prototype is an original work that has not been published elsewhere;
    (e) You are the copyright owner of the submitted photograph and/or images as its author, (and any individual whose image is featured in the photograph has given consent for the use of his/her image);
    (f) The exercise of the rights granted to the Whalebone Pizza Box Art Contest in these Rules & Regulations will not infringe the rights of any third parties; and you will fully indemnify the Whalebone Pizza Box Art Contest against any loss, liability, damage, cost or expense whatsoever resulting from any breach of these warranties.

Terms and conditions:

  1. By entering the Whalebone Pizza Box Art Contest, the Entrants are deemed to have read, understood, and accepted these Terms and Conditions and Rules and Regulations and agreed to be bound by them.
  2. Selected winners have one week after being contacted to respond to the Organizer, and if return contact is not made within that period, the prizes will be forfeited. The Organizer will select another winner in accordance with the selection criteria set out.
  3. The prizes include a pizza party for the winner up to $200. The winner will also receive a lifetime subscription to Whalebone Magazine for as long as the print publication is produced by Whalebone Media. Prizes must be taken as offered. Prizes are non-refundable, non-transferable, and non-exchangeable for cash or services.
  4. The winner will be contacted via email within 24 hours of the design being chosen by the Organizer, advising them they have won. The winner must respond to the Organizer claiming their prize by 5:00 PM on July 18, 2023.
  5. An unclaimed prize selection, if required, will be held at 10:00 AM on July 19, 2023 at the same location as the original selection. The winner will be notified via email within 2 business days.
  6. The Organizer reserves the right to refuse to honor any entry if they consider there has been an abuse of this Competition or a breach of these Terms and Conditions.
  7. The Organizer’s decision is final on any situation including any not covered in these Terms and Conditions. Please note that the Organizer will not enter into any correspondence concerning any decisions made.
